Terms of Use

These Terms of Use apply to the Trusapien Store at store.trusapien.com, wherever in the world you are buying from. They include our refund and cancellation policy, which is section 13. Our Privacy Policy forms part of these Terms.

1. Who we are

The Trusapien Store is operated by Trusapien Yapay Zeka ve Bilişim Teknolojileri A.Ş. (“Trusapien”, “we”, “us”), a joint stock company established in Türkiye, with its registered office at AOSB 1. Kısım Mah. 40. Cad. No: 4 İç Kapı No: 203, Döşemealtı / ANTALYA 07190, registered under trade registry number 0859154901400001, tax office ANTALYA KURUMLAR / 8591549014.

The Store sells Trusapien software. Everything offered in the Store is sold and licensed by us. No one else sells to you through the Store.

By creating a Store account, or by buying or installing anything from the Store, you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it, and “you” means that organisation.

2. Terms used in this document

  • Store — the Trusapien Store at store.trusapien.com.
  • Product — an agent, workflow, kit or module offered for sale in the Store.
  • Product page — the page in the Store describing a Product, including what it does and what the purchase includes.
  • Workspace — your Trusapien platform workspace, which you license separately from us.
  • Paddle — Paddle.com Market Limited, our payment provider and the seller of record for every Store transaction.
  • Consumer — a buyer purchasing for purposes outside their trade, business or profession.

3. Who you are dealing with

For the sale and the payment, you buy from Paddle. Paddle is the seller of record. The contract of sale is between you and Paddle, the receipt is issued in Paddle's name, and Paddle is responsible for payment processing, billing, currency handling and any applicable sales taxes. Paddle's own buyer terms apply to that sale.

For everything else, you deal with Trusapien. We license the Product to you, we run the platform it runs on, and we provide support for it. Your counterparty for the licence, the service and the support is Trusapien in every case.

We build some Products ourselves and license others in from our own suppliers. That makes no difference to you: we are the licensor either way, and we are responsible to you for every Product we sell.

4. Your Store account

You must be at least 18 years old and legally able to enter into a contract. Keep your account details accurate and your credentials secure. You are responsible for everything done through your account and by the people you give access to your Workspace.

5. A Workspace is required — read this before buying

Products run only inside an active Trusapien Workspace. The Workspace is licensed and paid for separately and is not included in any Store purchase.

If your Workspace is suspended, expires or is cancelled, Products you have bought cannot run. A one-time licence is not lost in that situation — it becomes usable again when your Workspace is active again — but no refund or credit is due for any period during which a Product could not be used because the Workspace was inactive.

6. What you are buying

The Store sells under two commercial models. Which one applies is stated on each Product page and again at checkout.

One-time purchases — agents, workflows and kits. A single payment for a perpetual licence to use that Product inside your Workspace, on the terms of section 7. What the purchase includes is described on the Product page.

Subscriptions — modules. A recurring fee at the interval shown at checkout, renewing automatically until you cancel. You may cancel at any time from your Store account. Cancellation takes effect at the end of the period you have already paid for, and the module stops working at that point.

Prices, billing currency and taxes are shown at checkout before you pay.

7. Your licence

We grant you a non-exclusive, non-transferable, non-sublicensable licence to use the Product you have bought, inside your own Workspace, for your own internal business purposes. For one-time purchases the licence is perpetual, subject to section 5 and section 15. For subscriptions it lasts as long as the subscription does.

You may not:

  • resell, redistribute, sublicense, rent or share the Product outside your organisation;
  • copy or run the Product outside your Workspace;
  • reverse engineer, decompile or disassemble it, except where the law permits this and you have first asked us;
  • remove or obscure any ownership, copyright or attribution notice;
  • use the Product, or anything derived from it, to build or improve a competing product.

All intellectual property rights in the Products belong to Trusapien and its licensors. Nothing here transfers ownership to you.

8. Changes to the Store catalogue

We may add Products, change them, or withdraw them from sale — for legal, security, quality or commercial reasons. Withdrawal stops new purchases immediately.

If a Product you have already bought is withdrawn from sale:

  • One-time purchase — your licence continues and you may keep using the version installed in your Workspace. Updates and new functionality may stop.
  • Subscription — we will give you reasonable notice, billing stops at the end of the current period, and the module stops working then.

We do not warrant that a Product will meet every requirement you have. Read the Product page before buying.

9. Token credits

Token credits bought through the Store do not expire. They have no cash value, cannot be transferred or exchanged for money, and are not refundable once purchased, whether used or not, except where the law requires otherwise.

10. Acceptable use

Do not use the Store or any Product to break the law, to infringe anyone's rights, to attack or probe our systems or anyone else's, to place an unreasonable load on the platform, or in breach of applicable export control or sanctions rules.

11. Your data

Your data remains yours. Products run inside your Workspace and process your data under our Privacy Policy and your platform agreement with us. We do not sell your data.

12. Fees, billing and taxes

All payments are handled by Paddle. Subscriptions renew automatically at the price and interval shown at checkout, using the payment method you provided, until cancelled. We will give you at least 30 days' notice before any price increase takes effect on a subscription renewal.

Prices are shown in the currency stated at checkout. Paddle calculates and collects any sales tax due where you are located, including value added tax and goods and services tax, and shows it before you pay. If you are a business registered for such a tax, you may be able to have it adjusted by contacting Paddle.

13. Refunds and cancellation

This section is our refund policy. It applies to every Store purchase.

13.1 In short

Purchases are not automatically refundable. We review every refund request individually and may grant a refund at our discretion. Your statutory rights as a consumer are unaffected, and Paddle's own buyer terms apply on top of this section. Token credits are dealt with in section 9.

13.2 Who decides a refund, and who pays it

Trusapien decides. We are your licensor and your support provider for every Product in the Store, so a refund request comes to us and we make the decision.

Paddle processes it. Paddle is the seller of record for every Store transaction. Once a refund is approved, Paddle returns the money to your original payment method.

Paddle may also refund independently. Under Paddle's own buyer terms, Paddle can decide to refund a transaction — for example within 14 days of a purchase or of a subscription renewal, or where it believes a transaction was made in error or fraudulently. Where Paddle makes that decision, it stands, and we treat the purchase as refunded under section 13.7.

You can send a refund request to us at support@trusapien.com, or to Paddle at paddle.net. Coming to us first is usually faster.

13.3 One-time purchases — agents, workflows and kits

These are delivered to your Workspace immediately after payment. Once delivered, there is no automatic right to a refund.

If you want one, tell us within 14 days of purchase and we will review the request. We look at whether the Product does what its Product page said it does, whether and how much it has been used, and the reason you have given. We may ask for detail.

If we grant a refund, it is for the full amount paid. The licence ends on the day the refund is issued and the Product is removed from your Workspace.

13.4 Subscriptions — modules

You can cancel a subscription at any time from your Store account. Cancellation takes effect at the end of the period you have already paid for, and the module stops working then. We do not refund part-used periods.

If a renewal charge takes you by surprise, tell us within 14 days of the renewal date and we will review it. We are most likely to refund where the renewal was clearly unintended and the module has not been used since it was charged.

13.5 Withdrawal rights if you are a consumer

In Türkiye. Law No. 6502 on Consumer Protection and the Distance Contracts Regulation give consumers a 14-day right of withdrawal for distance contracts. That right does not apply to digital content supplied immediately and not on a physical medium, where the consumer has given prior express consent to immediate performance and has acknowledged losing the right of withdrawal.

In the European Union and the United Kingdom. Consumer law there gives the same 14-day right of withdrawal, with the same exception for digital content whose supply has begun with the consumer's prior express consent and acknowledgement that the right is lost.

We take that consent at checkout, in this wording:

I expressly consent to the digital product being made available to me immediately after my order is confirmed, and I acknowledge that I therefore lose my right of withdrawal.

If you did not give that consent, or the product was not made available to you immediately, the 14-day right stands and we refund in full.

Anywhere else. If the law of the country where you live gives you a stronger mandatory right than this section does, that right applies and nothing here reduces it.

13.6 If a Product does not work as described

This is separate from everything above and is not discretionary, wherever you are. If a Product does not do what its Product page says it does, tell us. We will fix it or replace it. If we cannot do so within a reasonable time, we refund you in full, whenever you bought it.

13.7 What happens to your access

  • Refund granted — the licence ends on the day the refund is issued and the Product is removed from your Workspace.
  • Subscription cancelled — the module keeps working until the end of the paid period, then stops.
  • Chargeback raised — we may suspend access to the Product, and to your Store account, while the chargeback is being resolved. If it is decided in your favour, the licence ends. If it is decided in ours, access is restored. Please contact us before raising a chargeback; it is slower for you than asking us. Repeated chargebacks may lead us to close your Store account.
  • Renewal payment fails — we retry the payment and tell you. The module keeps running for a grace period of 7 days from the first failed attempt. After that it is suspended. Your configuration and data are kept for 30 days from suspension; paying the outstanding amount within that window restores the module as it was. After 30 days the configuration may be deleted.

13.8 Store purchases and your Workspace are separate

Refunding a Store purchase does not refund your Workspace subscription. Cancelling your Workspace does not refund Store purchases and does not end a one-time licence — but a Product cannot run without an active Workspace, and section 5 applies.

13.9 How to request a refund

Email support@trusapien.com with the order or receipt number from your Paddle receipt, the name of the Product, and what went wrong or why you are asking.

We reply within 5 business days. Approved refunds are processed by Paddle to your original payment method, normally within 14 days of approval. The amount you receive may differ slightly from what you paid, because sales tax is recalculated at the time of the refund and exchange rates may have moved.

14. Availability and changes to the Store

We may add, change or discontinue parts of the Store. We work to keep the Store and the platform available but do not guarantee uninterrupted or error-free operation.

15. Suspension and termination

We may suspend or terminate your Store account, and the licences granted under these Terms, if you materially breach these Terms, fail to pay, or use the Store unlawfully. Where the breach can be fixed, we will tell you and give you a reasonable chance to fix it first. You may close your Store account at any time; closing it does not refund purchases already made.

16. Warranties and disclaimers

We provide the Store and support with reasonable skill and care, and Products will perform substantially as described on their Product page. Beyond that, Products are provided as they are.

Products use artificial intelligence systems. We do not warrant that their outputs will be accurate, complete or suitable for any particular purpose. You are responsible for reviewing outputs before acting on them, and for any decision you take on the basis of them.

17. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law in the country where you live.

Subject to that, we are not liable for indirect or consequential loss, lost profits, lost revenue, lost data or business interruption. Our total liability arising out of or in connection with a Product is limited to the amount you paid for that Product in the 12 months before the claim arose.

18. Changes to these Terms

We may update these Terms. The version number and effective date at the top of this page always identify the version in force. For material changes affecting your rights, we will give at least 30 days' notice by email or by notice in the Store. Continuing to use the Store after that date means you accept the new version. The version in force on the date of a purchase is the one that applies to that purchase. Earlier versions are available on request.

19. Language

These Terms are published in Turkish and English. Both versions carry the same rights and obligations and both apply to buyers everywhere. If there is any discrepancy between them, the Turkish version prevails, except that a consumer may rely on whichever version they were shown at the time of purchase.

20. Governing law, jurisdiction and consumer rights

These Terms are governed by Turkish law, and the Courts and Enforcement Offices of Antalya have jurisdiction.

If you are buying as a consumer, this does not deprive you of the mandatory protections of the law of the country where you live, and it does not prevent you from bringing proceedings in the courts of that country. Consumers in Türkiye may also apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court in their place of residence.
